The glossary

Which assets go through probate?

Probate only touches assets that have no other way to reach their next owner: property titled solely in the deceased's name, with no beneficiary designation, no survivorship, and no trust. That single sentence sorts every asset you own into two lists.

The non-probate list moves on its own: trust assets, retirement accounts and life insurance with living named beneficiaries, POD and TOD accounts, beneficiary-deed real estate, and survivorship property. A death certificate and a form, not a court.

The probate list is everything else - and in an unplanned Arizona estate, the house is usually the biggest item on it. Estate planning, reduced to one move, is walking your asset list and giving every item a route off the probate side.
