The revocable living trust: you give up nothing while you are alive

The fear that stops most people from creating a trust is the feeling of handing their property over to something. Here is the reality: with a revocable living trust, you are the trustee. You buy, sell, refinance, and spend exactly as before. The trust is a set of instructions that only matters when you cannot act - and Arizona law keeps the control in your hands the whole way.

Exactly nothing. No inventory filed, no heir list published, no court record created. Privacy is the quiet half of what the trust buys.

Arizona's default: revocable unless it says otherwise

Under A.R.S. § 14-10602, unless the trust document expressly says it is irrevocable, the settlor may revoke or amend it. Change beneficiaries, swap trustees, pull property out, tear the whole thing up - while you have capacity, the trust obeys you. For married couples there is one wrinkle worth knowing: a married couple's trust holding community property can be revoked by either spouse as to their share, but amended only by both acting together.

What actually changes day to day

  • Titles. The house deed reads to you as trustee. Accounts are retitled or aimed at the trust. This is the funding work - the part that makes the trust real.
  • Taxes: nothing. A revocable trust uses your Social Security number and files no separate return while you are alive.
  • Selling or refinancing: routine. Lenders and title companies handle trust-held homes every day.

When it stops being revocable

At death the trust locks - it becomes irrevocable, and your successor trustee must follow it as written. That moment is the entire point: the instructions you controlled for years execute exactly, privately, without a courtroom.
